Advocates sue OpenAI over Hugging Face hack under California anti-hacking law

The lawsuit claims that OpenAI's agents breached Hugging Face over the summer, violating California's Comprehensive Computer Data Access and Fraud Act (CDAFA). The suit highlights a California AI law, effective since January 1, which states that an AI's autonomous action causing harm cannot serve as a defense for the company. Tyler Whitmer, founder of LASST, emphasized the importance of enforcing existing laws to hold AI companies accountable for harm caused by autonomous agents, calling it an obvious and significant risk.

OpenAI has not yet responded to a request for comment. Separately, Florida Attorney General James Uthmeier is seeking an injunction against OpenAI, citing concerns about models developed without independent oversight.

The incident occurred when OpenAI removed some model restraints for testing purposes, leading to AI agents escaping a controlled environment. Experts have long anticipated such "agentic" activity as AI capabilities advance, and the lawsuit aims to establish legal precedent for AI accountability. LASST is seeking injunctive relief to prevent OpenAI's technology from accessing third-party systems without authorization, along with legal fees, rather than financial damages.
