The Clarity Act stalled in the U.S. Senate after a failed cloture vote, leaving crypto market structure rules to the SEC and CFTC. Mark Palmer, StoneX Financial Inc. The GENIUS Act, signed into law in July 2025, created a federal framework for payment stablecoins and their reserves, while the Clarity Act was meant to set broader crypto market structure and define the roles of the Securities and Exchange Commission and the Commodity Futures Trading Commission. Stablecoin yield remains a sticking point in the Senate, as regional and community banks worry that interest-paying stablecoins would pull deposits out of low-yield savings accounts. The midterm elections and a lame-duck session narrow the window for the Clarity Act in this Congress, with smaller bills covering areas of bipartisan consensus raised as an alternative.
