Former CIA Director John Brennan has been subpoenaed to testify before a Florida grand jury next month as part of a Department of Justice investigation into whether former law enforcement and intelligence officials conspired against Donald Trump. Ken Wainstein, an attorney for Brennan, disclosed in a court filing that prosecutors presented him with a subpoena for Brennan to appear before a grand jury in Fort Pierce, Florida, on October 15.
Wainstein stated he was informed that the subpoena relates to a "far-reaching" criminal inquiry examining a theory that government officials who have investigated Trump over the last decade, including regarding Russian election interference and his retention of classified documents, conspired to deprive Trump of his civil rights. The subpoena to Brennan is among several issued recently.
Brennan's attorney was also informed that Brennan remains a target in a Washington-based investigation concerning allegations he lied to Congress in 2023, claims Brennan and his legal team have consistently denied. Subpoenas for testimony in that false statements probe were issued in the spring but later withdrawn in favor of voluntary interviews.
The subpoena was issued on the same day that Joe diGenova, the prosecutor leading the "grand conspiracy" investigation, resigned. A person familiar with the matter cited displeasure from the justice department and White House over the investigation's pace and management. The justice department has not publicly announced a replacement for diGenova. Kurt Olsen, a lawyer on the investigative team who had previously advocated for the Justice Department to support Trump's claims of a stolen 2020 election, was the member of the team with whom Wainstein spoke.
The disclosure of the subpoena came hours before a court hearing in Washington concerning a lawsuit brought by Brennan. He is seeking a court order to preserve records from investigations targeting him, arguing such documents are essential to challenge any potential indictment on grounds of vindictive prosecution.
