An Australian tribunal has granted three Israeli siblings the right to reapply for protection visas, finding they hold a genuine fear of persecution due to potential conscription into the IDF and being forced to violate international humanitarian law in Gaza.
This ruling establishes a precedent for individuals seeking protection in Australia based on fears of being compelled to violate international humanitarian law during military service, particularly in the context of the ongoing conflict in Gaza.
An Australian tribunal has ruled that three Israeli siblings, facing mandatory conscription into the Israel Defense Forces (IDF), have a genuine fear of persecution and are owed protection by Australia. The Administrative Review Tribunal found that the siblings' fear of being forced to breach international humanitarian law in Gaza, and the potential punishment of imprisonment for refusing service, amounted to persecution.
The tribunal accepted the siblings' deeply held beliefs that they would be compelled to engage in unlawful actions during military service in the Gaza Strip. It noted credible allegations that Israel's military operations in Gaza may breach international humanitarian law and are perceived by the international community as disproportionate.
The family, comprising parents and their adult children, had initially applied for protection visas in 2024 after their previous working visas expired, but their application was rejected. While the tribunal did not accept their claim of being unsafe from general terrorist attacks in Israel, it found the specific risk of persecution for refusing military service met the criteria for protection under the refugee convention.
The tribunal ordered that the family's application for protection visas be reconsidered, acknowledging the siblings' vow to refuse service and the potential consequences, including up to two years imprisonment. The decision also referenced international legal actions against Israeli leaders concerning alleged war crimes.
