US Accuses Man of Wiping Phone with 'Duress' Password at Border

The U.S. Justice Department is prosecuting Samuel Tunick, an Atlanta resident, for allegedly using a 'duress' password to wipe his phone's contents while being questioned by U.S. border authorities. This case is reportedly the first in the United States where federal prosecutors have charged an individual for destroying data using such a feature, which is available on custom operating systems like GrapheneOS.

Tunick's attorneys contend that the seizure of his phone upon his return to the U.S. last year was unlawful and that any evidence, including the alleged data wipe, should be dismissed. They argue that border agents detained Tunick without legal counsel and without sufficient justification, suggesting the investigation was motivated by his involvement in the 'Defend the Atlanta Forest' movement, which opposes a proposed law enforcement training campus.

The indictment accuses Tunick of providing a passcode that caused the phone to delete its digital contents before it was seized. His legal team filed a motion to suppress the evidence, asserting that border agents claimed they did not need a warrant because Tunick had not yet officially entered the U.S. The government maintains its authority to search devices at the border without a warrant.

Security experts and Tunick's legal team have highlighted the rarity of using the federal statute against property destruction to prevent seizure in such a context. Digital security experts suggest that individuals should be mindful of such features and consider data management strategies when crossing borders.
