Judge dismisses Adani case, criticizes DOJ official's conduct

A judge has dismissed a case against Adani and several associates, while also sharply criticizing the conduct of a Justice Department official involved in the dismissal. U.S. District Judge Garaufis described the decision-making process by U.S. Attorney McCotter as 'highly unusual' and showing a 'lack of respect for the Judiciary.'

Prosecutors and regulators had alleged in late 2024 that Adani and his associates orchestrated a scheme to defraud U.S. investors and global financial institutions. The indictment detailed claims that the defendants paid over $250 million in bribes to Indian government officials to secure lucrative solar energy supply contracts, subsequently hiding this scheme while seeking funds in the U.S.

Garaufis rejected McCotter's contention that the indictment was politically motivated, calling the assertion 'baseless' and 'unbecoming of his office.' The judge noted the absence of evidence to support claims of political motivation behind the timing or charging decisions.

A spokesperson for the Justice Department, Kiersten Pels, pointed to a court filing where McCotter stated the dismissal decision was made after consulting with defense counsel and department counsel, following his own research and analysis. The filing seeking dismissal from the DOJ included McCotter's and the Brooklyn U.S. attorney's signatures but notably omitted the names of line prosecutors.
