Judge Scraps SNAP Junk Food Rules, Jeopardizing MAHA Policy

In her filing, Jackson stated that while the federal defendants and states may have a genuine desire to improve the health of SNAP households, they cannot violate the law and their own regulations. She noted that Congress defined what 'food' is for SNAP and did not authorize the agency to amend or waive that definition to exclude certain types of food entirely.

The ruling specifically applies to bans in five states: Iowa, Nebraska, West Virginia, Colorado, and Tennessee. However, the legal fight could serve as a roadmap for challenges in other states, as the USDA had granted waivers to 23 states to allow them to ban unhealthy foods. Agriculture Secretary Brooke Rollins vowed to continue fighting the issue, though it remains unclear if the agency will appeal or seek alternative methods to prohibit the purchase of sugary foods.

Anti-hunger advocates argue that policing the shopping carts of low-income Americans is paternalistic and stigmatizing. Nutrition experts have also pointed to limited evidence suggesting that SNAP soda bans lead to better health outcomes, despite sugary drinks being a leading source of added sugars in the American diet.
