The Court of Justice of the European Union has ruled in favor of Ikea in a dispute over the Belgian far-right party Vlaams Belang's use of the furniture giant's branding in an anti-immigration campaign. The party had presented its "IKEA-Plan," an acronym for "Immigration can really be different," using Ikea's logo and characters to illustrate proposals for immigration reform.
Ikea sued Vlaams Belang in November 2022, alleging trademark infringement and stating that it did not wish its brand to be associated with political positions it did not support. The Belgian business court referred the case to the CJEU to balance freedom of expression with a company's right to defend its trademark.
The CJEU stated that the use of Ikea's trademarks for the purpose of reinforcing a political message does not take precedence over the brand's rights and interests, especially when the campaign is unrelated to Ikea's business and could create an impression of endorsement. The court suggested that a company can suppress controversial political expression if it can show a link between the company and the opinion expressed in the parody.
The case will now return to the Belgian court, which is expected to rule against Vlaams Belang based on the CJEU's interpretation. A spokesperson for Vlaams Belang stated that the party would thoroughly examine the ruling's scope.
