John Yoo, a former national security attorney in the George W. Bush administration known for his controversial legal opinions, will advise diGenova on an investigation into inquiries concerning Donald Trump's 2016 campaign and alleged ties to Russia. DiGenova previously served as the U.S. attorney for D.C. from 1983 to 1988.
Yoo gained prominence for memos defending the legality of so-called 'enhanced interrogation techniques,' which the Justice Department later formally withdrew, concluding he had shown 'poor judgment.'
Shortly after Trump's inauguration, Yoo co-authored an op-ed with Toensing advocating for the criminal prosecution of individuals who used 'lawfare' against Trump. He argued that such actions could deter future abuses and restore faith in an even-handed justice system.
Despite his conservative background, Yoo has previously questioned actions by the Trump administration, including strikes on alleged drug boats and efforts to overturn the 2020 election results. In 2023, Yoo testified in disbarment proceedings against John Eastman, a lawyer involved in efforts to overturn the 2020 election. Although Yoo testified on Eastman's behalf, his testimony was used in the ruling that Eastman should be disbarred for professional misconduct.
The Justice Department did not immediately respond to requests for comment regarding Yoo's role or the specifics of the investigation.
