The top federal prosecutor in Brooklyn, U.S. Attorney Joseph Nocella Jr., has stated he has no basis to dispute the U.S. Department of Justice's decision to abandon its criminal prosecution of Indian billionaire Gautam Adani. In a letter to the overseeing judge, U.S. District Judge Nicholas Garaufis, Nocella clarified that he was not the decisionmaker behind dropping the fraud and bribery case.
Nocella indicated that he had no reason to believe the grounds presented by Trent McCotter, a senior Justice Department official, for the dismissal were not the actual reasons. Judge Garaufis had previously asked Nocella to explain whether he agreed or disagreed with McCotter's reasoning and if there were other bases for dropping the case. Earlier, Judge Garaufis had stated that prosecutors "failed" to justify their move to dismiss the case, which involved allegations of a $250 million bribery scheme in India to secure solar-power contracts. The Justice Department had previously filed a notice stating it decided "not to devote further resources to these criminal charges."
