A federal judge has dismissed a $600,000 lawsuit filed by Alex Murdaugh against a former court clerk. Murdaugh had sought the funds as legal fees, alleging that the clerk's misconduct during his murder trial violated his right to a fair trial. His murder convictions and life sentences were previously overturned by the state supreme court due to comments made by the clerk to jurors, which suggested his guilt and undermined his testimony.
In his ruling on Wednesday, Judge Richard Gergel stated that Murdaugh's claim had a "fatal flaw" because there was no causal connection between the funds he expended for his defense and the clerk's alleged misconduct. The judge noted that the clerk had no role in the initiation of criminal charges against Murdaugh.
Murdaugh claimed he spent $600,000 from a retirement account for his legal defense in the first trial and anticipates needing more for his upcoming retrial. Despite his murder convictions being overturned, Murdaugh remains incarcerated. He is currently serving a 40-year federal sentence and a 27-year state sentence concurrently for stealing approximately $12 million from clients. His retrial for the murder charges is scheduled for April.
