‘You can see both sides’: Former judge believes Clancy murder trial could end in a mistrial

Jurors in the Lindsay Clancy murder trial in the US have been sent home after telling the judge for a second time they cannot reach a unanimous verdict. Former US trial judge and lawyer Ashley Willcott has explained why she thinks this case could be heading for a mistrial. “Part of the reason I think this is because if you watch the trial, you could tell that there was evidence to support the Commonwealth’s theory of the case that this was deliberate, intentional, premeditated, or an unlawful killing with malice,” Ms Willcott told News24. “But there was also evidence that supported the defence’s theory of the case, which was this was postpartum psychosis and, as a result, she should not be held criminally responsible; that’s why the jury’s hung up.”
