A final approval hearing for the National Association of Realtors' (NAR) homebuyer commission lawsuit settlement has been scheduled for November 2, 2026. Judge Linsay Jenkins, overseeing the Tuccori homebuyer commission lawsuit, announced the date after approving the method for notifying settlement class members.
The proposed settlements, which received preliminary approval in May, involve NAR contributing $52.25 million, Compass $7.33 million, eXp World Holdings $4.34 million, Hanna Holdings $8.25 million, HomeServices of America $30 million, and Douglas Elliman $2.04 million. These firms have collectively contributed over $120 million to a Global Settlement Fund.
These opt-in settlements stem from lawsuits such as Batton 1 and 2, Cwynar, Davis, and Lutz. Despite the preliminary approval, plaintiffs in other homebuyer commission lawsuits have attempted to block the settlements. However, Judge Jenkins previously stated that the terms are fair, reasonable, and adequate, having been negotiated in good faith by experienced counsel through mediation.
